This visa preference was created by Congress in 1990. It is available to immigrants wanting to enter the United States in order to invest in a new commercial (business) enterprise that will benefit the US economy and create at least 10 full-time jobs.

THE EB-5 CATEGORY gives two ways to invest:

a) Creating a new commercial enterprise or
b) Investing in a troubled business.

To qualify for US investor visa you must: Invest or be in the process of investing at least $1,000,000.
  • If your investment is in a designated targeted employment area (discussed further below) then the minimum investment requirement is $500,000.
  • Benefit the U.S. economy by providing goods or services to U.S. markets.
  • Create full-time employment for at least 10 U.S. workers.
    • This includes U.S. citizens, Green Card holders (lawful permanent residents) and other individuals lawfully authorized to work in the U.S. (however it does not include you (the immigrant), or your spouse, sons or daughters).
  • Be involved in the day-to-day management of the new business or directly manage it through formulating business policy — for example as a corporate officer or board member.
To qualify you must:
  • Invest in a business that has existed for at least two years.
  • Invest in a business that has incurred a net loss, based on generally accepted accounting principles, for the 12 to 24 month period before you filed the Form I-526 Immigrant Petition by an Alien Entrepreneur.
    • The loss for the 12 to 24 month period must be at least equal to 20 percent of the business’s net worth before the loss.
  • Maintain the number of jobs at no less than the pre-investment level for a period of at least two years.
  • Be involved in the day-to-day management of the troubled business or directly manage it through formulating business policy. For example as a corporate officer or board member.
  • The same investment requirements of the new commercial enterprise investment apply to a troubled business investment ($1,000,000 or $500,000 in a targeted employment area).
A Regional Center is defined as any economic unit, public or private, which is involved with the promotion of economic growth, improved regional productivity, job creation, and increased domestic capital investment. The organizers of a regional center seeking the regional center designation from USCIS must submit a proposal showing:
  • How the regional center plans to focus on a geographical region within the U.S., and must explain how the regional center will achieve the required economic growth within this regional area.
  • That the regional center’s business plan can be relied upon as a viable business model grounded in reasonable and credible estimates and assumptions for market conditions, project costs, and activity timelines.
  • How in verifiable detail (using economic models in some instances) jobs will be created directly or indirectly through capital investments made in accordance with the regional center’s business plan.
  • The amount and source of capital committed to the project and the promotional efforts made and planned for the business project.
    • We may help you by providing a list of Regional Centers for your convenience.
To qualify you must:
  • lnvest at least $1,000,000 or $500,000 in a regional center affiliated new commercial enterprise or a troubled business located within the area of the USCIS designated Regional Center. Regional Centers are defined and discussed further below.
  • Create at least 10 new full-time jobs either directly through the capital investment.
  • While many investors interested in living in the U.S. are eager to start a new business, some worry about the risk they feel is involved in investing in a market that is not familiar.
GOOD NEWS- introducing the REGIONAL CENTER:
  • the U.S. government offers an investment-based permanent residency opportunity. This takes the traditional investment AND job creation requirements of the individual EB-5 Investor Visa and consolidates it into structured, federally-approved “Regional Centers” which essentially offer the same immigration benefits while removing the task of new business creation from the investor.
  • TRADITION INVESTMENT + EB-5 JOB CREATION REQUIRMENTS = FEDERALLY APPROVED “REGIONAL CENTER”  —which offers almost the same immigration benefit WITHOUT the NEW business creation from the investor.
  • HOW DOES THIS WORK? It works like this: by pooling the investment funds of multiple investors, these highly controlled and professionally managed Regional Centers create diversified investment pools which not only stimulate the U.S. economy, but allow for indirect job creation. These investments and indirect jobs are essentially “pro-rated” among the investors to meet the requirements and they offer the SAME permanent residency.
  • GOAL FOR THE UNITED STATES:  a powerful economic impact on U.S. communities and jobs AND permanent U.S. residency for its investors.- MET THROUGH REGIONAL CENTER
  • This question will depend upon each unique investor but, basically, the primary reason is to pursue U.S. permanent residency without having to start your own “bricks and mortar” enterprise…by letting pro’s handle that aspect of it. Most Regional Centers are in designated high-unemployment or rural zones; that means that you invest $500,000 instead of $1 million…and that is pretty compelling for most.
  • The Regional Center receives and controls the investment funds and the investor does not have to run the investment enterprise; the Center also takes responsibility for ensuring that the investment there meets the ‘create 10 jobs’ requirement.
  • The idea, then, is to delegate most of the operational responsibilities of the investment activity to the management team, typically a seasoned group of investment and development professionals.
  • Choosing the right Regional Center is critical. As with any investment, each investor has a different risk tolerance. Some investors are excited, for example, by a Regional Center offering an investment opportunity in cutting edge technology; others are risk-averse and will take a very modest rate of return assured by bonds as opposed to something truly innovative. It is critical to have qualified financial counsel review your options as well as the investment documents, which can be lengthy and complicated.
To support the increasing popularity of the Regional Center program, USCIS recently released statistics on EB-5 applications:

Fiscal Year 2007:

  • Form 1-526’s. Immigrant Petitions forAlien Entrepreneur: 473 approved and 148 denied
  • Form 1-829’s, Petitions by Entrepreneuis to Remove Conditions: 111 Approved and 49 denied

Fiscal Year 2008:

  • 12 new EB-5 regional centers approved
  • Form 1-526’s, Immigrant Petitions for Alien Entrepreneur: 540 approved and 120 denied
  • Form 1-829’s, Petitions by Entrepreneur to Remove Conditions: 159 Approved and 68 Denied

There are currently 853 pending 1-526’s and 489 1-829’s.

There are 32 Regional Centers approved.

THESE NUMBERS SUGGEST SOME VERY GOOD NEWS FOR FOREIGN EB-5 INVESTORS WHO SEEK TO OBTAIN A GREEN CARD. THE USCIS IS DESIGNATING MORE NEW REGIONAL CENTERS. THERE ARE STILL AN ABUNDANCE OF INVESTOR VISAS AVAILABLE TO FILL THE ANNUAL CAP OF 10,000 AND THE APPROVAL RATE IS INCREASING,

  • Your spouse and unmarried children under the age of 21 may be admitted to the U.S. with you on a two-year conditional period.
  • If your I-829 petition to remove conditions is approved, then the conditions will be removed from your spouse and children’s Green Card status.
  • As a lawful permanent resident (Green Card holder) your spouse and children will be authorized to work or attend school in the U.S.

Acquiring lawful permanent residence (“Green Card”) through the EB 5 category is a three step self-petitioning process.

  • First the successful applicant must obtain approval of his or her Form I-526 Petition for an Alien Entrepreneur.
  • Second, he or she must either file an I-485 application to adjust status to lawful permanent resident, or apply for an immigrant visa at a U.S. consulate or embassy outside of the United States. The EB-5 applicant (and he or her derivative family members) are granted conditional permanent residence for a two year period upon the approval of the l-485 application or upon entry into the United States with an EB-5 immigrant visa.
  • Third, a Form l-829 Petition by an Entrepreneur to Remove Conditions must be filed 90 days prior to the two year anniversary of the granting of the EB-5 applicant’s conditional Green Card. If this petition is approved by CIS then the EB-5 applicant will be issued a new Green Card without any further conditions attached to it, and will be allowed to permanently live and work in the United States.
